These Terms of Service (“Terms”) govern your access to and use of the healthcaresales ai software, platform, APIs, websites, and related tools (the “Service”). “we,” “us,” and “our” refer to the operator of healthcaresales ai and its affiliates. By using the Service, you agree to these Terms.

1. Access and Use

1.1 Provision of Access

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for legitimate business communication, sales coaching, analytics, and call guidance in healthcare settings.

1.2 Inputs & Suggestions

You may provide audio, transcripts, prompts, and other inputs (“Inputs”). The Service returns AI-generated feedback and analytics (“Suggestions”). You are responsible for verifying Suggestions before acting on them.

1.3 Model Training

We do not use customer Content for base model training unless an authorized admin expressly opts in under a separate agreement.

1.4 Redaction of Sensitive Data

We use automated data masking and real-time redaction filtering to block sensitive information—such as payment card numbers, Social Security numbers, national IDs, and dates of birth—from being transcribed, displayed, or stored. Detected tokens are masked (e.g., **** **** **** 1234) or dropped prior to storage.

1.5 Use Restrictions

  • Do not resell or share access without authorization.
  • Do not use the Service to collect or transmit illegal or unauthorized data.
  • Do not reverse-engineer or attempt to extract source code or model weights.
  • Do not use the Service to train a competing model or product.

1.6 Beta Features

Experimental or preview features are offered “as is,” may change or end at any time, and may have additional terms.

2. Eligibility

You must be at least 18 years old (or of legal age in your jurisdiction) and legally able to enter into contracts.

3. Account Registration

Provide accurate account information and keep it current. You are responsible for maintaining credential security and for activity on your account. Report unauthorized use to support@healthcaresalesai.com.

4. Payment Terms

4.1 Pay-As-You-Go Model

The Service operates on a metered, pay-as-you-go basis. Usage is billed according to minutes and/or interactions processed. There are no recurring subscriptions unless explicitly stated in a signed enterprise order form.

4.2 Activation and Setup Fees

Some accounts may include a one-time activation or setup fee disclosed at checkout or in the applicable order form.

4.3 Pricing

Current rates are shown on our pricing materials. We may update pricing with notice. Taxes and any payment-processor fees are your responsibility.

4.4 Payment Processing

Payments are processed through third-party processors (e.g., Stripe). By submitting payment information, you authorize charges for amounts owed based on your usage.

4.5 Billing Cycles

Usage charges may be billed immediately after each call, daily, or monthly depending on your account type. Metered usage invoices are due upon receipt unless otherwise specified.

4.6 Delinquency

Late or failed payments may result in suspension of the Service. We may recover reasonable collection costs and fees permitted by law.

5. Ownership & Licenses

We and our licensors retain all intellectual-property rights in the Service. You retain rights to your Inputs and resulting Content. You grant us a limited license to process and host your Content solely to operate, secure, and improve the Service.

6. Third-Party Services

The Service may depend on external providers (e.g., telephony, transcription/inference engines, billing). Your use of those services is governed by their terms; we are not responsible for them.

7. Communications

We may send you service-related and promotional messages. You can unsubscribe from marketing at any time; system notifications may still be required for essential account operations.

8. Changes to Terms

We may revise these Terms periodically. Material updates will be communicated via email, in-app message, or this page. Continued use of the Service after changes are posted constitutes acceptance.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, abuse, non-payment, or legal compliance. Sections 5 through 17 survive termination.

10. Changes to Service

We may enhance or retire features at any time. If we permanently discontinue a paid feature, you will receive a pro-rated refund for any unused prepaid balance tied to that feature.

11. Copyright Complaints

To submit a DMCA notice, email support@healthcaresalesai.com with: (a) your physical or electronic signature, (b) identification of the copyrighted work, (c) the location (URL) of the material, (d) your contact information, (e) a good-faith statement that the use is unauthorized, and (f) a statement under penalty of perjury that the notice is accurate and you are authorized to act.

12. Privacy

We use strong encryption and automatic redaction filters to prevent high-risk personal data from being transcribed or stored in transcripts and logs (including payment card numbers, SSNs, national IDs, and dates of birth). 13. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses arising from your Content, misuse of the Service, or violation of these Terms or applicable laws.

14. Warranty Disclaimer

THE SERVICE AND ALL SUGGESTIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OR PERFECT ACCURACY OF AI OUTPUTS OR TRANSCRIPTIONS.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY SIX-MONTH PERIOD IS LIMITED TO THE GREATER OF: (A) AMOUNTS YOU PAID FOR THE SERVICE IN THAT PERIOD OR (B) USD $100.

16. Dispute Resolution

Except where prohibited, disputes will be resolved by binding arbitration (individual basis only; no class actions). You and we agree to the exclusive jurisdiction and venue specified in the applicable order form or, if none, our principal place of business.

17. Miscellaneous

These Terms are the entire agreement between you and us regarding the Service and supersede prior understandings. If any provision is unenforceable, the remainder remains in effect. A failure to enforce any term is not a waiver.
